Yes , I did see that, but at what point do they consider this as "inventory" -- waiting for visa having pre-adjudicated (gosh, I hope not!) or as we all are thinking -- applications that have reached the agency...

I have received an RFE on my H1-extension too. USCIS wanted sealed copy of my trnascript from my foreing university.
To answer the original poster. You can file your I-485 since your extension is pending and you do have a receipt fro USCIS.

I never heard of an RFE for H1b extension. Are u sure that the RFE is not related to your I-140 or I-485?

Sorry to hear that. Hope that will not effect your I-485 application processing.
For me, I have not seen any status change to my 140. After a series of LUDs to both 485 and 140 at last today I see my 485 status has changed. It says RFE sent. If a person has filed an I485 and has a valid H1 visa stamp in his/hers passport, no AP is needed when traveling as h1 is a "dual intent" visa. This applies to H1 and L1 visas. When leaving this country when I485 is pending, the I485 will not be deemed as abondomed because one travels on a "dual intent" visa. IF one, however, had filed an I485 while being on a diffrent type of a visa, like F1, or B2, one MUST obtaint AP before leaving. Other wise the person will NOT be able to re-enter the country even if one has a valid F1 or B2 visa and the I485 will be deemed abandomed. This is because by filing the I485, he/she has shown an immigrant intent, and both F1 and B2 don't allow for such intent.
So many people don't realize that a H1 or L1 are very POWERFUL visas.
I am not an attorney so do not take my answers for granted.

53,872 ( EB2 Total allocation in 2010 ) = Some X (EB2 ROW usage is say X) + 19,961 ( Total India received in 2010) + 6,505( Total China's received in 2010)

Hi pakrish, similar situation here. My wife's gc has the gender mentioned incorrectly. From what I've researched, we need to file for I-90 and choose option D - correction in green card. There are no fees required as it's a USCIS mistake but the original card needs to be sent with the form.

I am applying for AOS on a EB basis. My wife will apply along with me as a beneficiary. Unfortunately she worked on H1B for another company without notifying USCIS and on a different job capacity. What are the chances for her I485 to be denied? Do we have to mention that in I485 form. She is currently on H4 and is not working. Thanks.

I sent a hand written letter to the President and CC'd it to CA IV PO BOX. and I feel a lot better after writing it.
I have also sent a personalized hand written letter to the Colorado Congressmen Ed Perlmutter. I will set up a meeting once I get a positive response or in the next few weeks, whichever is earlier.

My lawyer tried calling USCIS to find out the details and they mentioned they are still processing the July 2nd cases and application are stored in 4 different warehouses.
According to her at this point we can do nothing but wait until they finish processing all the application.

CADude and others... maybe your efforts are paying off. What I learned in this process is that have faith in your application filing. If everything is fine you'll definitely get the receipts. It may be either next week or in 2 weeks.
Couple of things...
1) Calling USCIS is useless...
2) Look for checks for cashed....
3) Keep in touch with our pending group. I gives you support and motivation.

I will request you/attorney write to USCIS PO Box 82521 and attach the copy of delivery proof and RN to correct the error. Atleast no harm in trying.
If your country is retro then RD don't mean much. They will arrange the file in "visa hold self" sorted by PD. But any time DOL/USCIS make India again "C" then RD matters.
What's your ND on RN?

My attorney is planning to send out the paperwork on June 29 to reach by monday july 2nd , is there any problem to this, is there any risk involved in sending on 29th, is anybody else doing this ? Please respond, this is urgent.
I read somewhere in the forum that one guy contacted USCIS regarding I-140 PP and he was told by USCIS representative that they honor Postmark date. If USCIS honors Postmark date not the receive date they one must be careful sending application on June 29th.

Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??
Please try to understand their problem.

Just my 2 cents... Don't think USA is like India where you can do something forcefully. Why don't you guys understand the real problem of USCIS.
Do you think that by sending flower to USCIS will force them to make EB2/EB3 current for 2005/2006/2007 guys??
