1. If a Receipt Number is issued for a I-485, does it necessarily mean that the case won't outright be rejected for a missing document/ evidence, but instead an RFE will be issued?
2. When a receipt number is issued for a I-485, and if we send out the missing document/initial evidence using the allocated A#, is there a good likelihood that the evidence/document will make it to the appropriate file?
Answers to these will help make a decision on filing multiple I-485's where the first I-485 missed some initial evidence.

it looks like many folks got their approval one day after filing an SR - coincidence or a trigger? Is filing the SR somehow triggering the IOs to look at your file ?
However, many people who filed SR on the first working day of the month 08/02 were not approved the next day. Also, the many others who bombarded the USCIS with multiple requests/queries had to wait much longer or are still waiting.
It is almost like the IOs didn't like to be bothered on the first working day of this month (when the begin working on a fresh set of files) and also didn't like to be pushed too much.
Or is this all just a super coincidence for hundreds of people?

I'm also in same situation only difference is my visa stamped in PP is expired (Jan06), but has H1 till Jan 2009. I'm planning to visit India in Feb07 and return on AP. As I read in other forums that H1 will be valid and we can file for extension (even Cornin INS Memo (5-16-00)) memo says that. My attorney also confirmed that.

I would suggest you to get h1 your visa stamped from India and enter on h1 and not on AP. Don't even show your AP to the immigration inspector at the POE.

We are hearing from multiple sources that, on Monday or Tuesday of next week, State Department plans to issue a revised Visa Bulletin for July 2007. This revised Bulletin would retrogress some or all of the employment-based categories, very likely to the point of unavailable. Reports from AILA members about unusual levels and types of activities by USCIS indicate a particular push to adjudicate employment-based adjustments currently in the pipeline so as to exhaust visa numbers for fiscal year 2007.

I personally do not travel through a country that are biased and requires a transit visa for specific countries only. If you think about it, most of the international flights are full of us, Indians. If everybody (including Indians with GCs, that do not require a transit visa) start boycotting such airlines/country transits, then they will have to change this policy.
As I said before, I am never going to fly thru UK, even though I sill have a transit visa valid till Nov 2008. I can still feel the pain.

The Department of State announced that the Indian EB2 category is expected to advance one week in the May Visa Bulletin. The demand for EB1visa numbers has decreased by 50 percent this fiscal year. Last year from October 2009 to February 2010, 22,000 EB1 numbers were used. During the same period this year, only 10,000 to 11,000 have been used. EB1 will be current worldwide all fiscal year. This will free up an estimated 12,000 visa numbers to fall down from EB1 to EB2 this year

No, we didn't raise a SR after the interview. I was planning on doing it early next week since I had not seen any LUDs since our interview, and then we found a nice surprise this morning. But, if you are wait has been longer, it certainly won't hurt to do it. Good luck in your case too.

Travelling via London Gatwick and Dubai to India and back. No airport change required during transit. Using AP, visa expired. I have a valid Canada PR card.
According to UK embassy US GC and Canada PR card holders do not need transit for direct airside transit. Does anyone have any experience in this situation? Please post. Thanks

Yes, the same law can be interpreted like this:
EB1-ROW unused visa will go to EB2-ROW
EB2-ROW unused visa will go to EB3-ROW
Same for each country.
But its not happening. What actually is happening that they are giving unused visa from EB1-ROW to EB2-ROW to EB2-I/C. WHY?
So EB3-ROW is retrogressed bcoz it doesn't get any spillover and hence it affect EB3-I.
So where is the correct interpretation? Does any body know?
Don't take me wrong here. I don't favor EB3-ROW or any particular category. I am EB3-I with PD Nov 2002.
This was the law till 2000 (vertical spill over). After 2000, because of AC21, the INA got changed to horizontal spillover. This means each employment catagories are seperatly free from country quota if demand is less than supply in each catagory. If you analyze word by word in the language of the AC21 act, you will understand. Unfortunally (fortunatly for EB3) DOS has not interpreted the law correctly till 2006. Now they are interpreting correctly.
5) 2/ RULES FOR EMPLOYMENT-BASED IMMIGRANTS-

just a question on #2 above - if you are filing second AOS with EVL, why not just withdraw the first AOS once you get the receipt? Wouldn't this be safer?
