For those in South ( Texas, Oklahoma, New Mexico, Louisiana) best way to go to India is new Emirates direct flight between Houston and Dubai and then onward to India.
I have had 3-4 friends fly this route since they started flying in November 2007 and they have nothing but praise for everything. These guys have excellent food and entertainment and no transit visa hassels plus duty free sopping in Dubai is good.
Pluse - they put you up in a hotel if your Dubai layover is more than 8 hrs (for economy class passengers) and you get a free transit visa to visit Dubai. During my last trip to Bangalore, I went via Dubai (NYC - Dubai direct flight) and on my way back we had 11 hrs layover. My wife and I got a chance to see the city. Next time we are going to India we are planning on staying for a few days and go for their desert camp trip.

Your Logic is Illogical in the first place...
In Labor substitution, a person who lands in US last friday, could substitute a labor and get ahead in line of a 2002 guy.
In Porting case he/she is the original beneficiary. So you comparing Porting to Labor Substitution is totally illogical...
PD porting is another labor sub in making. I hope I have presented my case logically to show who all are the people who are in position to be benefitted by this rule. Of course there will be some genuine cases too but on other hand think about the people in Eb2 line that will be severely affected.

We are hearing from multiple sources that, on Monday or Tuesday of next week, State Department plans to issue a revised Visa Bulletin for July 2007. This revised Bulletin would retrogress some or all of the employment-based categories, very likely to the point of unavailable. Reports from AILA members about unusual levels and types of activities by USCIS indicate a particular push to adjudicate employment-based adjustments currently in the pipeline so as to exhaust visa numbers for fiscal year 2007.
This follows the actions of USCIS in June, when it began rejecting EB-3 "Other Worker" adjustment applications even though the Visa Bulletin showed an October 2001 cut-off date, on the basis that the "Other Worker" numbers for the year had been exhausted:mad: :mad: :mad: :mad:

How can we get this issue more visible to IV members? Just 64 letter is not enough. We are a community of 30K strong!!!

Looks like most of IV members are being ignorant of these issue, this will be a big issue if not acted fast. We need to get it corrected before it becomes a major one. Look at DOL's unemployment figures 6.5% unemployment was announced!!!! Worst since 1994.

This disclaimer in VB, does not say "mid-month". It takes about cut off dates via bulletin only. Also, this means USCIS put some thought behind the time they will have to announce cut-off dates. They new the demand will ber "very heavy".

my 485 was filed during Aug 2007 , i had EAD as well that i never used.(EB3)
i joined another firm and started off fresh using old PD, and EB2, which got ported
I had 2 RFE on my prior 485 FOR medicals and EVL. that i answered ( company didnt had issues as long as i was paying for it)
now How do i get my prior 485 to be merged, since its not an easy case, my new firm isnt willing to do so, can i raise SR/IO and try it? is it worth it
Have you asked your lawyer? Check with your lawyer first as you say it is a little complicated. You don't want to mess up this late in the process.....

US court already clearly given vertict to BS+5 years alone itsef qualify for EB2. It was a major ruling against INS.
US educated (or holding master degree) is no way superior than holding BS+5 years experience if job requires more experience . Similarly BS+5 years is no way superior than MS, if job requires absolutly Masters degree (like research).. So dont compare each other, as each has its own merits. Education and experience cannot replace each other.
However, One can send a petition to DOL/USCIS to deny the second LC/140 application if an employer files two LC/I-140 for a single person (same employer -same beneficiary) for a similar kind of job, just to help the employee to line jump from EB3 to EB2. This may work to stop abusing the system.

I am in for this.
If some one has entered US legally and filed for GC, it means (most of the cases) they will wish to naturalize at some point..Technically once GC is approved path to citizenship steps up.
I like this idea of pushing for citizenship..but I would like to remove the clauses of measuring length of stay from 140-approved or 485-applied etc.
Why shouldnt we say, anyone who worked in US for 5 years (which means paying taxes etc)
should be naturalized directly ...When they can make illegals legals why not us?
Do we have a group in Linkedin? If not, I can take up the responsibility of spreading through Linkeid groups for support (I dont like facebook so I am not on it and Linkedid is supposedly a professional network)

Several readers commented on a posting earlier this week about 200 skilled immigrants from India who tried a Gandhi-like tactic and sent flowers to the government's immigration director for help in moving their green card applications along. The U.S. Citizenship and Immigration Services forwarded the flowers to soldiers recovering at Walter Reed Army Medical Hospital, saying it understood the intent of gesture.

As a highly skilled H1B worker in the US, let me the set the record straight on a few common misconceptions:
- Many of us come from upper middle class families and didnt come to the US 'seeking quality of life'. We already had it.
- Many of us have graduated with distinction or higher from TOP US universities where we competed with 'local' talent and aced the programs, with NO SPECIAL FAVORS
- All of us are PASSIONATE about the PROMISE of the GREAT AMERICAN DREAM. We work hard because we want to, not because we need to. (Hint: We are ambitious and can hence go to any country in the world!)
- All of us are an INTEGRAL part of this society, paying 28%-33% of our $100K+ jobs as TAXES that go back to the US economy
- All of us continue the great tradition of the US being a melting pot
Go back to the age of the Gold Rush. We are the new Gold Rush. We are the new Lewis and Clarke. We are adventurers, learners, experiments, believers, doers.
We are not lowly paid 'tech slaves'. Get the media misconception out of your heads.
We are PROUD to be part of the Great American Fabric. We strengthen this country with our diversity. We will continue to contribute selflessly to make this a greater, stronger nation.
And while we are it, we wont forget that our own future generations might take it more lightly and risk messing up their careers. Anyone that has 'life handed to them in a platter' ends up messing it.
So, please take your heads out of the sand, quit being protectionist and complaining the someone moved your cheese. Look at how you can move and be flexible, nimble and adaptive.

There is no ambiguity in law. The law is clear. One law (and one rule) should yield one interpretation. If someone interperting the languge of law differently; then that is their mistake. Thats what DOS was doing in between 2001 and 2006.
The law comes actually down to the following two rules:
(1) horizontal spill if visas available
(2) vertical spill for visas not required
The language in (2) is much stronger. A visa number that is still available cannot be required at the same time. So one could argue that DOS is now misinterpreting the law.

Just talked to a recruiter from a software giant.
She specifically wanted to know if I was on EAD and if yes, unfortunately they cannot hire EADs during the fourth quarter (now) due to hiring budget limitations that are typical during the fourth quarter.
Q: Why does budget come in to picture here?
A: Because policy requires the legal dept to be consulted for visa holders and EADs which means additional hiring costs plus time.
But she said once the fourth quarter passes, EAD hiring is not a problem.

These are interesting facts. macaca - you really have lot of time on hand- I think it is generally accepted that dobbs has lost his mind. I remember an interview on charlie rose - where he asked whether Turner tolerates this guy (I dont remember the exact words ..).
I for one have stopped watching CNN ...I even sent emails to others who have programs on CNN that because of this idiot I have stopped watching CNN ..maybe others should do the same - next step ofcourse is to send emails to companies who sponsor his show. ofcourse we should not ignore such a hater (dobbs) ..the problem is that dobbs inaccuracies leads to hate crimes

I for one have stopped watching CNN ...I even sent emails to others who have programs on CNN that because of this idiot I have stopped watching CNN ..maybe others should do the same - next step ofcourse is to send emails to companies who sponsor his show. ofcourse we should not ignore such a hater (dobbs) ..the problem is that dobbs inaccuracies leads to hate crimes

I140 approved at NSC over a year ago.
NSC was supposed to have finished with July 2 long time ago. We thought it was late only when NSC to TSC transfer is involved.
