Is there a formal way / method to let the company and USCIS know of such discrimination ? Any published guidelines from USCIS ?
My wife works for TCS and is on vacation .We tried contacting the local office here .Though the guy mentioned that they have projects ,he still wants her to goto India and comeback on TCS visa and sent her a email that TCS policy doesntnot allow EAD holders.

nov 2004, EB2 I still waiting.
Texas, biometrics...
finally got FP notices and the appt. date was october 21st. I did a walk-in to ASC and got it done on sept. 29th. So, the cases will have the way cleared up for oct. 1st. There was an LUD on 30th, may be a result of biometrics uploading. No movement after that.
both cases are with same IO as per infopass. senators enquiry came back saying wait for 45 to 90 days. Processing in the order we received them.

I saw posts of several members extremely skeptical of the whole idea, even went on calling it stupid, crazy and useless. Some made mockery suggesting sending dead fish etc. I don't see any more posts from them.

Actually, this is a new rule it seems. We also faced it this time. Airlines have to verify the visa. When I was flying through Air India via jfk and also when I was returning from India, both times my visa on my passport was scanned by airlines official. You will see some guy carrying a laptop kind of device and he/she will scan your visa before even you go for boarding pass. In our case, since visa was expired they asked for Advanced Parole.
It was on Dec 2005 . Luftansa . Chennai - Frankfurt- Dallas . I was waiting for my boarding pass . I handed over my e ticket to the lady at the counter. Instead of issuing the boarding pass , she asked me about my H1B papers. I got confused . Why should I show my papers to this lady ? . Mamit: Take a deeeeeeeeep breath! Good for you that you are dealing with this right at the start of your career. Get all the bad stuff out upfront. I have a family and life to take care of in the US and I am stuck in this crap since Jan 7th. It is extremely hard and frustrating - but there is simply nothing that you can do about it right now. So, relax and wait it out.
The PIMS stuff is all messed up and iff you have a common name, your lottery for "Security Clearance" may have come. That would significantly add time to it. If this is your first stamping - the chances of rigorous checking is higher - although that is not always the case.
It is easier said than done - but seriously, let the life take its own course, this too shall pass and soon!

Ok, I had hoped not to bite the bait, but I am human, nothing recharges and roils like someone saying "you are EB3, you are worthless compared to US the mighty EB2s".
The misleading continues
1) "VDLRAO" (no disrespect to his prediction capabilities) says EB2 will be current soon, so why are you raising this voice.
Well, if it is going to be current soon enough, then any action to redirect EB1 numbers should not be a cause of concern for EB2s should it? If you are going to become current soon, then it means there aren't many people waiting in the queue.
2) We should support the visa recapture
You all are assuming that EB3 does not support it. Unlike me, most EB3s are very active in calling, contributing and supporting those events. I have personal reservations about asking for a change in law when I am the direct beneficiary (I feel like those big oil companies who use their clout to get laws favourable to them, nothing wrong, just that I dont like to do it). Having said that, I have no problems in asking and demanding that the law be applied as written.
Once I have my GC done with, I intend to write to the representatives that barring progressive experience in the same company rule should be removed, because it is the experience that matters, not where you get it. Why should someone who chooses to be loyal be discriminated against another who has no qualms about his company's future.
3) You dont have the law on your side, USCIS/DOS only implements the law.
Some within EB2 concede that the law is fuzzy, while others claim there is no basis for our campaign here. Well, there was no basis for so many things that IV has accomplished, and yet, most people accept that we are better off in some ways compared to pre-IV. If you believe that we have no basis, then why bother dissing us? We will make ourselves look like fools. If you believe the law is fuzzy, then you should realize that current interpretation is your luck, not your right.

If her lawyer is quick to respond then you can keep everything ready including medicals and anytime date is retrogressed should apply immediately or the second option is apply for EAD and AP and I-485 case and go tense free and use EAD if you want to change jobs and don't worry about EB2 and EB3.

That's been my understanding all along. Applications are approved per the Notice Date, provided the applicant's PD is current. But I know, we've all seen exceptions to that rule. I guess this is more relevant in your case since you're current, but I'm not, so it doesn't really matter too much anyway. I just don't want any RFEs.
I think the program scoops up all the applications on that date and check whether the dates are current, pre adjudicated and available visa numbers. then it may move to the case officer or approval or "automagically" approves the Green card!!!!:D

There are lots of ideas how to resolve the immigration problem. And this problem has many aspects. The retrogression/GC certification mess is just one of those problems and definitely not the biggest one of the bunch.
If we want to help ourselves (i.e. GC applicants stuck in the backlog centers and retrogression trap), we have to have a clear strategy what to pursue and by what means. In opinion, there are two things which would be helpful to our cause in a short run:
1. Representing our case to the American public via the mass media - one of the participants here clearly indicated that proper presentation of our case by 20/20, 60 min etc would be a great help.
2. Launching a class law suit against the American government about return of Social Security funds to legal aliens who do not became permanent residents and leave the country. Regardless of the reason why they have left the country - this is their money !
I am aware there is no enogh time to organize and complete both events before March 27th but it worth try. And it would be good if the idea of a class law suit "slips" away to the mass media and the lawmakers before this date. Money is a very powerful factor.
And, btw, do not close yourselves in a "race-abused" group (Indians-Chinese-Filipinos) and do not draw a line between this "group" and the rest of the immigrants. It is big mistake - I am from a country that is not in this group and I feel that dividing people by their race is wrong. I am sure that many other like me think this way. Do not help the "race" issue grow, try to exstinguish it...

Wish there was a way to nudge USCIS on quicker approvals- most people know that there is case is pre-adjudicated,with IO and current. Now, if IO is taking a look at EB-4 applications then who knows..when our apps will get picked up
