This is a very good question. When I was on H-1B visa, at that time, it can not be extended beyond 6 years. At that time, people will move to home country/Canada for 1 one year, plan to move to O visa if qualified, will try to regain time for out of US time etc. The argument was gaining strength that person should get green card before her/his 6 years are up. To make matter worse, H1 and H4 time was counted together.
Now, rather than providing the long term solution of increasing the quota for green cards per year, EB based applicants were offered band-aid solution of extending H1 indefinitely beyond 6 years if labor is pending > 365 calendar days or I-140 is pending/approved. This was further sugar coated that if I-485 is not approved in standard processing time of 6 months, applicant can change GC job for same/similar classification. People were very happy with AC-21 and many thought (and they still think) that getting EAD is like a provisonal green card, as they can change job easily and employer can no longer "control" them.
Now, since H1 can be extended beyond 6 years, the arguement for faster green card has become weaker. Reason is simple, since applicant can work for "green card sposoring" employer for infinite time, even if I-485 is not filed.

Why this is the news is good and relevant from the point of view EB provisions?
Because EB provisions (section 8001) were thrown out of S.1932 because of the differences between key players over the Patriot act. Now that this is out of the picture, at least there is one less thing to worry about.

My attorney said only copy of recent i-94 and i-797 required.
I-94s are submitted at the airport when you leave the country. In many cases there are no I-94s coz they have been submitted and no one thought of making copies of them before travelling out of country. I am sure I dont have all the I-94s that I ever used. I submitted them at the airport when I went out and didnt make copies.

Fill it with both primary and derivative details. Write in small font with a pen. This will avoid different forms for each applicant.
If you take 1st line you want to write two names in it, that would create a confusion.
If I fill up another applicaiton for derivative, I have to fill up the same way as I filled for myself right? then I will go for this option.

I am not saying that we are reporting fraud just for the sake of not tolerating it. This is effecting our GC. Earlier the effect was related to the job being taken away now it is effecting our GC too.
Initially L1s were sponsored only by large offshore companies like TCS, WIPRO etc.. The effect was that the jobs were taken away. But it did not have much effect on the GC side as most of these large offshore companies do not process GC for their employees.
But nowadays lots of small Offshore companies started doing L1As. These companies do not have lots of clients like TCS or WIPRo but they have a handfull of clients. So to make sure they have their clients they started bringing people in L1As and processing GC under EB1 for them. Although many of these people are developers and should be in EB3 and should be behind in the line. But as they are in L1A and are appling in Eb1 they are getting GC in no time and also taking the visa#s away. There are hunderes of these small offshore companies started getting people in L1As. Thus these EB1 Visa #s are not overflowing to EB2. This is effecting our GC.
Now we have :
1. Large offshore companies sponsored L1s taking the jobs
2. The small offshore companies sponsored L1s taking the GC visa #s.
If the L1As are indeed senior Manager then no problem, but the Developers/Business Analyst/ Project Manager without hire-fire authority are getting GC under EB1.
Thus these frauds should be reported so that at least the # of EB1 visas are not taken by fraud.
So you too can see how this fraud is effecting us all.
Do you know why we are having GC delays ?
1. Country cap for visa numbers
2. Visa numbers wasted by USCIS by their inefficiency
EB1 visa never belonged to EB2 or EB3 category. What if there were enough genuine EB1 people to claim all the EB1 visas. There won't be any spillovers. Spillovers are bonuses. It is never our right to claim those.
If you want your GC faster, work with IV for country cap removal and recapture.
Have you donated a single dime for IV's cause ?
We always find it easy to go against fellow immigrants than fighting the injustice at root.

First off, interesting thought. I thought about this a lot. A lot of my friends are citizens now. Most of them came at the same time I did or even after I came. They were at the right place at right time and did not languish in SWA & BEC like I did and did not wait in 485 queue for years like I am now.
It may be difficult to sell the idea of 10 year presence , but I believe the following may be palatable :
Consider the 140 approval date or I485 filing date towards calculation of the 5 years of residency requirement instead of GC approval date. You are technically approved to be a resident when 140 is approved. You are ONLY WAITING to be status adjusted for lack of numbers.
having said that I have NO expectation that we can achieve this. Think about it, we can't get simple things about GC done and aim for Citizenship :)
reminds me a famous quote about , some one who can't climb to the roof aiming for moon. (I sound pessimistic, but I am damn deserved to be one :)

I concluded the same ( Though never posted that analysis :)) But It looks like we are missing a very critical point - we are assuming that " these pending numbers are the total 485 workload USCIS has" but I referred a different chart on USCIS board and it looks like there is a separte hoard of "preadjudicated" applications already sitting in a queue apart from these numbers. Hi All,
I am on a business trip to Chennai and I was interviewed for my H1-B renewal on Dec 6th 2007, unaware of the PIMS as it was not mentioned anywhere on the website that it will take this long to receive the passport. I was granted my visa within few minutes but till date (Jan 1st, 08) I have not received my passport. Was interviewed at the Chennai consulate. It has been heights of frustration as I had to spend all my Christmas holidays and New years at Chennai with all my fly being in US. I was supposed to return to US on Dec19th had to postpone my tickets to Dec 24th and then to Dec 29th. Now finally I have cancelled my tickets as it was costing me $200 every time I modify my itinerary.The US consulate, Chennai keeps on extending the processing time from 3 to 7 to 10 and it has been 15 working days already now, but still no passport in hand. Last week on Friday (Dec 28th) got an email that it might take additional 7 working days, huh ! Good thing is my company is in Chennai so atleast I can go to work or else it would have been really painful.

My point is not everyone wud then leave Vonage and move to another service , thats how Vonage wud gain, again are u sure u read the complete fine print :P
If they change the "contract" you agreed to initially - then you have every right to get out of the contract without any termination fees. It may take some arguing with the CS - but I know some people who have done this successfully with telephone companies like Verizone/Sprint etc when they changed some inconsequencial T&C.

(2) Send Emails
(3) Send Letter And/Or Posters
These tasks are in priority order becasue we have short time and later one can take more time. So lets call which is real time. Emails are may be 1-2 days delay . And Letter and posters are 7-10 days delay.
Please call ASAP.

I am a big supporter of Obama and a big fan and am eagerly looking forward to see him as our next President of United States. As a legal highly skilled immigrant what can I expect? Well, not sure if I would see myself living here anymore. I have been in the green card queue for more than 8 years now and still waiting. Will Obama's administration do anything for people like me to help reduce backlog? I doubt such a thing will ever happen. I would see myself and people like me discouraged and start packing our bags and move on with life.
Why do I feel discouraged? If anything is going to happen for the immigrant community when Sen. Obama becomes the President, it is going to be in the lines of CIR 2007. There would be provisions to make illegal immigrants as legal and remove backlogs to family based quota whereas posing harsh restrictions on H1b visas and reducing Green Card quotas and scrap AC21 portability and try to experiment with some new kind of skilled immigration system.
The above is very evident based on the fact that Senator Durbin has been very hostile to EB immigrants. I am afraid that Senator Durbin will make the calls when Senator Obama becomes the president.
Please post your opinions. This is a very important discussion. It is very important that the community see what is in store for us when the new Administration takes charge.

Why do I feel discouraged? If anything is going to happen for the immigrant community when Sen. Obama becomes the President, it is going to be in the lines of CIR 2007. There would be provisions to make illegal immigrants as legal and remove backlogs to family based quota whereas posing harsh restrictions on H1b visas and reducing Green Card quotas and scrap AC21 portability and try to experiment with some new kind of skilled immigration system.
The above is very evident based on the fact that Senator Durbin has been very hostile to EB immigrants. I am afraid that Senator Durbin will make the calls when Senator Obama becomes the president.
