First let me state that I need people like you to proceed and hence I will be happy to answer the points you rasied to the best of my ability:
We all agree that there is severe backlog. Only way the backlog will alleviate is by increasing visa numbers, which not going to happen any time sooner.
So some people (and I know around 10 of them) what they are doing is the following:
They got the chance to file their 485 last July , which is pending. They are now contacting several small desi consulting firms to file for their fresh labor in EB2 category. Once their labor is filled and new I-140 is approved, they plan to attach new I-140 to the original 485 and hence effectively convering to Eb2 category but with priority dates in 2002 and 2003 (because original I-140 had that priority). Worst, they would never join that desi consulting firm...
This how the system is being gamed. If I know 10 such cases, I am sure there must be thousand like that. Now you tell me , isn't that unfair to the people already in Eb2 line as well as the ones who do not know how to game the system
By the way: If any one is interested, I know of three such consulting firms that can do for you for a fee.
First: I appreciate that you have not lost your cool yet despite all the opposition and rude posts against you. Rollingflood on the other hand does not share those qualities with you well. We will not close the thread as long as the discussion remains civil.
While I personally do not support the lawsuit idea because it divides the community in two parts and there are better ways to help the community. You can try to help positively for the greater good for everyone or run a negative campaign that will help some but hurt others who are also like you and are genuinely following the law. I also think it will be expensive and may not have a lifeline. As IV members we need to all work together to fix the system. This was the basis of founding IV. The aim was never to look after our own selfish interests and hurt others who are like us. We never discriminated between different EB categories or country of chargeability. The intent of our fight is not to deny others their greencards and get ours first, but to allow everyone get their greencards. The intent is to have the system be efficient and work the way it was intended. IV core team has never made action items or ask lists in campaigns to suit their own selfish needs.
Now in this post you have raised a serious issue. If a fraud is going on, do collect evidence and file a complaint against it. If consulting companies are making money by gaming the system, drag those companies in your complaint. Help punish such people who are gaming the system. IV community will appreciate that.
There is some wisdom needed here to draw a line between selfishness and working with honest intentions to clean up the system.

It could also be that they are confusing your EAD with EADs used mostly by students on OPT which leads to H1B to Greencard sponsorship.

Big companies like TCS cannot split or start another company as everything is associated with Brand name and other stock market regulations. They will be forced to hire citizens/GC holders with H1bs if this bill is passed in same form. USCIS will take care of small Indian bodyshoppers by RFE and asking client letters etc if they start multiple companies. Of course there will be loopholes our Indian companies will find in any law but still it will clean up H1b and L1 atleast for some extent.
They refer to ads on Sulekha and other similar portals
On another note - consulting companies will workaround by creating multiple companies and applying h1b through various companies

My attorney is planning to send out the paperwork on June 29 to reach by monday july 2nd , is there any problem to this, is there any risk involved in sending on 29th, is anybody else doing this ? Please respond, this is urgent.
I read somewhere in the forum that one guy contacted USCIS regarding I-140 PP and he was told by USCIS representative that they honor Postmark date. If USCIS honors Postmark date not the receive date they one must be careful sending application on June 29th.

Smitha,
First, questions to you: What makes you visit this website silently?
Why do you even bother reading updates about ongoing GC issues?
You very well know that GC comes when the time is ripe, so you should really enjoy your sweet time instead of lurking on these forums.
Response to your meaningless and backward looking post: Iam glad you were not born during our independence days. Otherwise, you would have said the following (rephrased your post)
"
I am a silent citizen of this country (read India).
Just my 2 paise... Don't think UK is like India where you can do something forcefully. Why don't you guys understand the real problem of British.
Do you think that by performing salt satyagraha you can win over britishers and get Independence????
Please try to understand their problem.
Also UK is the great. Why don't you guys just think that UK is your home country where you can emmigrate and brought up. Why you people can't just wait and watch?? If nothing happens to the so called Independence, then why don't you think to pack up and get out of India???????
My sincere request, please don't do strikes, quit India movements, satyagrahas, you might be arrested......you never know what they can do..... Don't you think that, it is better to go to UK rather than being embarrassed here in India???
Isn't it a shame on us to go for Rally to get Independence?????:D
Just think that you will get it when time comes, otherwise quit India.
Please don't take much tension as life is very short. I am assuring you all, nothing will happen with freedom struggle and strikes.Don't irritate UK by doing all this please.

Would anyone be able to advise if I can travel out of the country after I've filed the 485 if I have an approved I-797 approval notice (for H-1B) but old H-1B stamp in pp has already expired?
If I travel out and then get the H-1B visa stamp at an outside consulate, I would be able to travel back in, but would I have considered have abandoned the 485 application? (since I travelled out without a valid H-1B stamp in pp)??
Can I travel out even before my AP arrives? Or does having an AP make a difference? I would prefer to stay on H-1B status since you never know what happens to the 140/485 application.
Thanks for the help guys.
I am in the same situation as yours. The visa stamp on my passport expired last year and I have an approved I-797, which is valid till Oct'07. I am planning to file for I-485 on June 1st and I want to travel to India as soon as I can. My attorney's advise was to wait for receipt of I-485 application and then travel to India and get H-1B stamped on my passport from a US consulate in India. According to him this is not considered as abandoning I-485.

It really is amazing how much hot air has been generated on this thread over a well established transit visa requirement.
The reason transit visas are required in the UK is that many passengers with an intention to transit the UK have stayed. The transit visa was introduced as a way of making sure (as much as possible) that the passenger has the intention and the ability to transit the UK and to enter a third country.
The list of nationals that are required to have a visa to transit the UK represents a list of countries where there has been a particular problem with over stayers. It is not race based, but merely an effort to target the problem.
It really does not matter what anyone thinks about the transit visa requirement because it is UK law. Everyone has a choice whether or not to transit the UK. Going back to the original post, to book a ticket without researching visa requirements and then trying to deflect personal responsibility by blaming the visa requirement is ridiculous.
If one doesn't like transit policy of a country, just avoid that transit point, rather than putting curse on that country ( or try changing the policy of that country through democratic means, if one can ).

I must say y'all are doing a commendable job. I have contributed $$ and would do so more in the future if needed.
I remember Senate Majority Leader Bill Frist saying that the comprehensive immigration reform bill will be handled in February 2006. Is the schedule still the same. I am keeping my fingers crossed and hope that everyone of us stuck in this immigration hell-hole will get a relief from the comprehensive immigration reform bills that (hopefully) will be passed in 02/06.
Thank you.

Well done Dilip Tekkedil! Your quote in the Washington Post article was too good!
Dilip Tekkedil, 32, a software engineer from North Andover, Mass., is one of the frustrated applicants who came up with the flower idea. "It was more peaceful," he said. "We don't trouble anyone else. A rally or something, you have to call law enforcement. It's too much trouble for other people." They do not hold hard feelings against Gonzalez. "I'd like to thank him for the job that he does. I know it's a thankless job," Tekkedil said. "I just hope that he could understand our plight as well."

Another thought... they might have been confused with EAD through L1/B1 etc dependent and EAD through pending AOS. The first case is temporary and depends on the primary applicant status. See if thats their concern and clarify...
Good luck!!!
yagw
It does not matter. EAD is unrestricted employment authorization and has no conditions attached due to basis it was issued. Of course, EAD can be revoked due to basis no longer available (such as expiration of L2 Status), but person can work as long as EAD is valid.
Form I-9 Employment Verification - Form I-9 Services from Form I-9 Compliance, LLC (http://www.formi9.com/form-i9-faqs.aspx)
[From the link]
Q. Can I avoid reverifying the I-9s by not hiring persons whose employment authorization has an expiration date?
A. You cannot refuse to hire persons solely because their employment authorization is temporary. The existence of a future expiration date does not preclude continuous employment authorization for an employee and does not mean that subsequent employment authorization will not be granted. In addition, consideration of a future employment authorization expiration date in determining whether an alien is qualified for a particular job could be an unfair immigration-related employment practice.

Hi Guys,
I have a concurrent filed application (140 still pending) dated back to Oct 2004 and another I-485 application from July, 2007 from different labor but a recently approved 140. My current EAD & AP is based on the first 485 (Oct 2004) which are due for renewal in next 4 months. Now I want my EAD/AP to be based on July 2007 I-485 (second one) since underlying 140 is approved. Here is my dilema:
1. When I renew EAD/AP should I check that its renewal or initial application option.
2. How can I make sure (atleast try) the new EAD/AP will not be tied to old 485 but the new one (will send the new 485 receipt & 140 approval notice).
Thanks for any suggestions/thoughts you might have.
Thanks
There is no concept of "multiple EAD and AP" assigned to single person as far as I know. So it does not matter what " you want" what matter is "what USCIS wants". And so far what I have heard (From professional and wellknown lawyers), multiple 485 filings is the last thing you want to even think about because USCIS does not like it and at the end of the day what matters is "What USCIS wants" so talk about that to lawyers as well so down the road you would not end up any delay or problem by USCIS due to multiple filings.

We should send emails to Jon Stewart, Stephen Colbert, Jay Leno, David Letterman, Conan O'Brian, Jimmy Kimmel etc.
They have tremendous amount of viewership and seems like a perfect material for these shows. I will send email to these guys but if more and more peple can make them aware of this development, this news can potentially snowball. :D
